The Organization: The
International Finance Corporation, a member of the World Bank Group, promotes sustainable private sector investment in developing countries as a way to reduce poverty. IFC, through the Private Enterprise Partnership (PEP), also executes a major donor-funded program of private sector advisory work in Eastern Europe, Central Asia and the Caucasus. The objectives of the program are to promote direct investment in the private sector, build local businesses and financial intermediaries, and help improve the business enabling environment.
The Project: Georgia Business Enabling Environment Project activities focus on 3 objectives: working directly with government to reduce the regulatory burden to business, conducting a nation-wide small and medium enterprises survey and improving the legal awareness of SMEs.
This includes work with government and regulatory agencies to streamline the process of obtaining business permits/licenses and improve inspections of business; publishing a regular survey on the business environment for small and medium enterprises in Georgia. The objectives of the survey are to measure the regulatory costs and analyze the main administrative and regulatory obstacles faced by local SMEs, to monitor the impact of reforms on the private sector, and to develop policy recommendations for improving the business environment. The legal awareness component should address the information gap on the recent regulatory changes affecting businesses in Georgia.
Scope of the job: Key responsibilities of the
Legal Advisor will include advising on legislative and regulatory reform in the areas of inspections and permits/licensing and providing training and consultation to government officials on these areas. He/she will be directly involved in the drafting of specific regulations aimed at improving business-enabling environment in Georgia and conduct research and analysis of key regulatory processes in Georgia.
Duties and responsibilities:
- Work with the Government of Georgia to implement changes to inspections and to the process of obtaining licenses/permits;
- Research legal basis for key regulatory processes in Georgia and incorporate this knowledge into technical advice;
- Develop specific legal policy recommendations to improve the environment for business development which can be presented to the government and to donor community to enable change;
- Conduct focus groups with entrepreneurs and government officials in order to understand how regulations are implemented in practice;
- Develop contacts and manage relationships with the Project counterparts;
- Deliver presentations at seminars targeted to government officials and the private sector;
- Prepare respective sections of the business environment survey and donor reports and write articles on business environment issues, if required;
- Identify the existing or potential problems that result from either the legal basis for a procedure or its practical application. Identify the legal source of any potential problems;
- Prepare monthly update / analysis of regulatory changes, if required;
- Provide support and information to the project team on all legal issues affecting the project's work.
Requirements/Qualifications:
- Advanced degree in law and minimum 5 years of relevant professional experience in administrative law;
- Hands-on experience in legislative drafting and developing legal commentary;
- Strong practical, up-to-date knowledge of legislation and regulations affecting the private sector;
- Results-oriented approach with strong problem-solving skills;
- Ability to understand and succinctly summarize complex concepts for a non-specialist audience;
- Fluent in Georgian and English, both written and oral;
- Excellent writing and presentation skills;
- Team-oriented and well-organized, patient and sensitive to company politics, self confident & convincing, optimistic and energetic.
